Mediation is an entirely voluntary process, meaning that unless both parties want to mediate, it's not happening. So, what do you do if the other party tells you they'd rather watch paint dry than attend mediation?

Before you give up, we suggest you try at least one of the following:

  • Call them or set up an in-person meeting to ask what their concerns are about the mediation process.

  • Refer them to the FAQ section of our website.

  • Have them call our office so we can answer any questions or concerns they may have.

  • Write them an old-fashioned letter (not an email) asking them to mediate.

  • Have our office call them to discuss the mediation process and its potential benefits.

If the other party still isn't willing to mediate, don't automatically assume that you'll end up in court. Sometimes, mediation just isn't the right fit for some parties, but the majority of cases still end up settling before trial.
